Resumes for H1-B Application

When someone prepares a resume, they want to present their best side to the world. Unfortunately, this can come back and bite you if you are not careful. If you work for SmallConsulting, Inc., on a project for Microsoft, do not state on your resume that you worked for Microsoft. Show that you worked from SmallConsulting on a project for Microsoft.When the CIS sees a resume attached to an H1B petition, that shows “employment” with someone other than a company that petitioned for the foreign national, they immediately assume that there is either unauthorized employment or fraud in the case. Either way, the result is a lengthy RFE and a presumption by the CIS that something is wrong.

An important corollary to this rule is never tell a CBP officer at a port of entry that you work for a company, when you in fact work for another company on a project for that company. Using the example above, don’t say that you work for Microsoft, when you work for SmallConsulting on a project at or for Microsoft. CBP has your records and if what you tell them does not match their records precisely, you will have problems.
